Flyling Terms of Use

These terms are an agreement between you and Epsilondelta Inc., Suite 401, Girin Building, 6 Yeoksam-ro 73-gil, Gangnam-gu, Seoul, Republic of Korea ("we"), for the Flyling app and its online features (the "service"). By agreeing on the first screen and using the service you accept them. Our Privacy Policy explains how we handle your data.
1. Who can use Flyling
You must be at least the minimum age for your country shown in the app (for example 14 in Korea, 13 in the United States, and 13 to 16 in EU countries). If you are under that age, do not use the service; the app does not let you make a fly.
2. What Flyling is
Flyling lets you raise and teach a virtual fruit fly. Its behaviour comes from a computer model built from public scientific data about the fruit-fly brain. It is a simulation for entertainment and learning: it is not a real animal, its results are not scientific findings about real flies, and nothing in it is medical, veterinary or scientific advice. The sources of the brain data are credited in the app (Settings).
3. Your account and your fly
- When you make your fly, the app creates an account for you without asking for your name or email. You can link an Apple or Google account in Settings to keep your fly when you change phones.
- One fly per account. Starting over replaces the fly kept on our server.
- Keep your device and your linked account secure; what is done with your account is your responsibility unless it was not your fault.
- You can delete your account and data at any time in Settings → Delete account and data. It removes your fly and records from our server and your device and cannot be undone.
4. Clips you make and share
- Clips are made on your device. You own them; we do not receive them.
- When you share a clip, you decide where it goes and you are responsible for it. A clip from the front camera can show your face and the people around you: check it before you share, and respect other people's rights.
- Apps you share to (for example TikTok, Instagram, YouTube) have their own terms.
5. Fair use
Do not: - break the law, or use the service to harm others; - interfere with the service or its servers, get around its security, or reach other people's data; - copy, change or redistribute the app, its character or its brain model except as the law or an open-source licence allows; - use bots or automated means against the service.
We may suspend or end an account that seriously or repeatedly breaks these terms, after telling you where we can.
6. Our rights and other licences
The app, the Flyling character and its artwork, and the brain model are ours or our licensors' and are protected by law. We give you a personal, non-transferable licence to use the app for your own use while these terms apply. Scientific data and open-source software in the app stay under their own licences, listed in the app.
7. The service as it is
Flyling is free. We work to keep it running, but it may change, pause or stop, and features may be added or removed. We will tell you in advance of an end of the service where we can, so you can download your data (Settings → Download my data). Except where consumer law does not allow it, the service is provided "as is" and "as available", without warranties of any kind, express or implied.
8. Liability
Flyling is free. To the extent the law allows, we are not liable for indirect or consequential loss, or for loss caused by things outside our reasonable control, and our total liability to you is limited to KRW 100,000. This limit does not apply to loss we cause intentionally or by gross negligence, and nothing in these terms limits liability that cannot be limited by law (such as for death or personal injury) or your rights as a consumer where you live.
9. Changes to these terms
If we change these terms in a way that matters, the app will show the new version and ask you to agree before you go on. If you do not agree, you can stop using the service and delete your account.
10. Law and disputes
These terms are governed by the laws of the Republic of Korea, without taking away the protection that the consumer laws of your country give you. Disputes go to the court that has jurisdiction over our head office in Seoul, unless the law of your country lets you bring them where you live. If you live in the EU, you can also turn to your national consumer authority or an out-of-court dispute body in your country; we are not obliged and do not commit to take part in alternative dispute resolution.
